Terms of sale
1. Scope and provider
1.1 These terms apply to every contract for a coaching package that you conclude with me through this website. Your contracting partner is Katia Triggiani, trading as Katia Triggiani Coaching & Consulting, Kurwenalstraße 7, 80804 Munich, Germany. Email: [email protected], phone: +49 172 469 5268, VAT ID: DE366333427.
1.2 A consumer is anyone who buys for purposes that are mainly outside their trade, business or profession (§ 13 BGB). A business customer is anyone who buys in the course of their trade, business or profession (§ 14 BGB), including a company buying a package for an employee. Where a clause applies to only one of the two, it says so.
1.3 Terms of business of business customers do not apply, even if I do not object to them, unless I have agreed to them in writing.
2. The packages
2.1 The content of each package, including the number and length of sessions, the additional services and the programme period, is as described on the package page at the time of your order, and is summarised in your confirmation email.
2.2 Sessions are held one-to-one and online, by video call on a service we agree on (for example Zoom, Microsoft Teams or Google Meet). A session lasts 55 minutes; a check-in lasts 20 minutes. You receive the link to the call before each session. Sessions are held in English, German or Italian, as we agree.
2.3 Coaching with me is individual. We work on your own situation, decisions and goals; exercises, resources and feedback are chosen or written for that situation. There is no fixed curriculum, no pre-recorded course content, and no examination or test of what you have learned.
2.4 Where a package includes them, the additional services work as follows:
- An email feedback exchange is one message from you, with any attachment, and one written reply from me.
- A document review covers one document of up to five A4 pages.
- Check-ins are scheduled by agreement, for decisions that cannot wait for the next session.
- WhatsApp support (Lead Through Change only) is for short questions between sessions. I reply on working days, within a reasonable time. It is not an emergency service. Using WhatsApp is your choice: the same support is available by email.
2.5 Coaching and mentoring are not psychotherapy, medical treatment, or legal, tax or financial advice, and do not replace them. If you are receiving, or think you may need, psychological or medical treatment, please tell me before we start, so that we can decide together whether coaching is right for you at this time.
2.6 I provide my services with professional care, but I cannot guarantee a particular result, such as a promotion or a specific outcome of a conversation. The decisions you make, and their consequences, remain yours.
2.7 The coaching is a contract for services under German law (§§ 611 et seq. BGB). Your statutory rights in the event of defective performance apply.
3. How the contract is concluded
3.1 The packages shown on this website are not a binding offer, but an invitation to place an order.
3.2 When you click “Enrol now” on a package, you are taken to a checkout page operated by my payment provider, Stripe (Stripe Payments Europe, Ltd., Ireland). There you enter your email address, payment details and billing address and, if you buy as a business, your company name and VAT ID. By ticking the box provided you accept these terms and, as a consumer, expressly request that coaching may start before the withdrawal period ends (see section 12).
3.3 Before you pay, you can review all your entries and correct them directly in the input fields, or leave the checkout with your browser’s back button. By clicking the payment button you place a binding order for the package.
3.4 The contract is concluded when the checkout confirms your order. Once your payment has been received, I send you, by email, a confirmation with the details of your package, a link to book your first session, these terms and the information on your right of withdrawal.
3.5 The contract language is English. I store the details of your order; these terms are available on this page at any time and are included in your confirmation email, so you can save or print them.
4. Prices and payment
4.1 All prices are in euros and include the statutory German VAT (currently 19%).
4.2 The full price is due when you order and is paid through the payment methods offered at checkout. You receive an invoice by email. Sessions are scheduled once the payment has been received. If a payment fails or is reversed, I can postpone the sessions until it is settled or, after setting you a reasonable deadline, cancel the contract.
4.3 For business customers in another EU member state with a valid VAT ID, the reverse-charge procedure applies and the invoice is issued without German VAT. The amount charged is shown at checkout before you pay.
5. Scheduling, programme period and rescheduling
5.1 After your purchase you book your first session through the calendar link on the confirmation page and in the confirmation email, or we agree a date by email. We then agree the following sessions together.
5.2 The programme period of your package starts with the first session. All sessions and additional services must be used within the programme period plus three months. Services not used by then expire without compensation, unless the delay was caused by me.
5.3 You can cancel or move a session free of charge up to 24 hours before it starts. If you cancel later or do not attend, the session counts as held, unless you were prevented by circumstances beyond your control (for example sudden illness) and let me know as soon as possible. If you join late, the session still ends at the agreed time.
5.4 If I have to cancel a session, for example because of illness, I will let you know as early as possible and offer you a new date. The session is not lost, and the period in 5.2 is extended accordingly.
6. Your part
6.1 For online sessions you need a stable internet connection, a device with camera and microphone, and a quiet place where you can speak freely.
6.2 Sessions are not recorded, by either of us, unless we have both expressly agreed to it beforehand.
7. Confidentiality
7.1 I treat everything you share with me in confidence, during and after our work together. The only exceptions are where I am required by law to disclose information, or where there is a serious and immediate risk to someone’s life or health.
7.2 If a company pays for your coaching, it receives no information about the content of our sessions. With your consent, I may confirm to it that sessions have taken place.
7.3 As an ICF Professional Certified Coach and EMCC Senior Practitioner, I follow the ICF Code of Ethics and the Global Code of Ethics for coaches and mentors.
8. Packages bought by a company for an employee
8.1 A company can buy a package for one of its employees or managers (the “coachee”). The company is then my contracting partner; the coachee receives the coaching. The company names the coachee by email after the purchase, and can name a different coachee until the first session has taken place. It makes sure the coachee knows sections 2, 5, 6 and 7 of these terms.
8.2 Section 7.2 applies to the company. The right of withdrawal in section 12 does not apply, as the company buys as a business.
9. Materials
Worksheets, templates, plans and other resources I provide are for your own personal use or, for business customers, for internal use in connection with the coaching. The copyright remains with me; please do not publish or pass them on.
10. Ending the contract and refunds
10.1 A package is agreed for its programme period. Apart from the right of withdrawal (section 12), neither of us can terminate it early without a reason.
10.2 The statutory rights to terminate remain unaffected, in particular termination for good cause (§ 626 BGB) and, where it applies, § 627 BGB. If the contract ends in this way, you pay for the services provided up to that point, and I refund the rest of the price in proportion to the services not yet provided.
10.3 If I am unable to provide the remaining sessions, for example because of prolonged illness, and we cannot find new dates within the period in 5.2, I refund the price of the sessions not provided in proportion to the total number of sessions in the package.
10.4 Beyond sections 10.2, 10.3 and your right of withdrawal, unused sessions and services are not refunded.
11. Liability
11.1 I am liable without limitation for damage caused intentionally or through gross negligence, for injury to life, body or health, under the German Product Liability Act, and where I have given a guarantee.
11.2 For slight negligence I am liable only if I breach an obligation that is essential to achieving the purpose of the contract and on which you may regularly rely (a cardinal obligation). In that case my liability is limited to the damage that is typical and foreseeable for this kind of contract.
11.3 These limitations also apply to anyone acting on my behalf.
12. Right of withdrawal
12.1 As a consumer, you have a statutory right to withdraw from the contract within 14 days. The full information, the online withdrawal function and the model withdrawal form are on the page Right of withdrawal.
12.2 When you accept these terms at checkout, you also expressly request that coaching may start within the 14 days, so that your first session can take place as soon as you wish, and you acknowledge that you lose your right of withdrawal once the package has been provided in full. If you withdraw after coaching has started, you pay an amount in proportion to the services provided up to your withdrawal; if no service has been provided yet, you pay nothing.
12.3 Business customers have no right of withdrawal.
13. Data protection
How I handle your personal data is described in the Privacy Policy.
14. Complaints and dispute resolution
14.1 If something is not right, please tell me first at [email protected]; I will do my best to find a solution with you.
14.2 I am neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
15. Final provisions
15.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of the country where you habitually reside.
15.2 If you are a merchant, a legal entity under public law or a special fund under public law, or if you have no general place of jurisdiction in Germany, the place of jurisdiction for all disputes arising from the contract is Munich.
15.3 The version of these terms in force when you order applies to your contract; it is attached to your confirmation email.
15.4 If any provision of these terms is or becomes invalid, the rest of the contract remains valid, and the statutory provisions apply in place of the invalid one.
